Is my Prostreet XBOX game a dud?

I moved out the house and bought an XBOX 360. I got myself a second hand copy of Prostreet from a game store the other day. When the intro plays it's very laggy! Terrible frame rate in the video. The menus and game play seem perfect though. I do sometimes notice a drop in framerate when there are a lot of cars on the screen as well. Just wondering if this is all normal. I have Forza 2 and Grid and they work 100%. I hope they didn't sell me a 2nd hand dud

My game works totally fine although mine isn't used its new... So it could be a dud? or just badly scratched.

your disk may need a good cleaning if it isn't scratched.
